Article 1 - Object

These General Conditions have as their object the purchase of products carried out remotely via electronic network on the puntoluce.net website belonging to Web-E Srl with registered office in Sasso Marconi Bologna via Porrettana, 278. The purchase and sale of products and services via electronic means is governed by articles 45 to 67 "Consumer rights" of Legislative Decree no. 6 September 2005. 206 (Consumer Code) and by Legislative Decree 9 April 2003 n. 70 regarding electronic commerce. The sales contract stipulated between the Customer and Web-E Srl will be governed and interpreted in accordance with Italian law.

Article 2 - Acceptance of the general conditions of sale

The Customer, by sending electronic confirmation of his purchase order, unconditionally accepts and undertakes to observe in his relations with Web-E Srl, the general and payment conditions transcribed below, declaring that he has read and accepted all the information provided to him pursuant to the above-mentioned regulations, also acknowledging that Web-E Srl does not consider itself bound to different conditions unless previously agreed in writing.
Web-E Srl considers the contract definitively concluded, except in cases of return or withdrawal, at the moment of delivery of the product to the carrier. Before this moment the availability of the product and the receipt of the money is essential, if you have chosen an advance payment. In the case of payment by cash on delivery, the contract is concluded with the payment of the carrier upon receipt of the goods.

Article 3 - Customer commitments

These General Conditions of Sale must be examined online by Customers visiting the puntoluce.net website before they confirm their purchases. The forwarding of the order confirmation therefore implies full knowledge of these General Conditions of Sale and their full acceptance.

Article 4 - Purchase methods

puntoluce.net is an online site for the sale of generic electrical products. Purchases of the products, available as illustrated and described online in the relevant descriptive and technical data sheets, are made by the Customer at the price indicated therein, to be confirmed at the time of forwarding the order confirmation, plus transport costs as follows specified in the following art. 6, and where applicable also collection costs, and in any case displayed at the time of purchase.

Before confirming the purchase, the Customer will be given a summary of the unit cost of each chosen product, the total cost in the case of purchasing multiple products, and the transport costs. By confirming the order, upon completion of the transaction, the Customer will receive an email message containing the Number, Date and Total Amount of their Order.

Upon receipt of payment (if you have chosen the bank transfer, postal order or postepay method), the product will be sent to you with the shipping method of your choice. To shorten the time, the customer can send the payment via fax.
The order can be canceled within 24 hours of receiving the order confirmation via e-mail or fax and in any case before the order status changes to "shipped"

Article 5 - Payments

- PayPal paying with PayPal is one of the fastest, safest and freest systems. All banking data managed by PayPal and transmitted securely via automatic encryption.

- Credit card for payments with the Mastercard, Maestro, American Express and Visa circuits.

- Multisafepay credit card for credit card payments we use the Multisafepay system. The cards accepted by Multisafepay are all those of the iDEAL circuit, Giropay , Mister Cash , SOFORT banking .

- Advance bank transfer this payment is the safest for the supplier and the customer. The bank transfer details will also be displayed at the end of the order.

- Cash on delivery payment by cash requires that the collection be made directly by the courier upon delivery. Please remember that the courier does not handle change, so it is advisable to prepare the money in cash exactly . For cash on delivery payments there is an increase equal to 1% of the amount spent with a minimum of 5 requests from the courier for money management and transfer to the seller.
Punto Luce reserves the right, where it deems it appropriate, to ship the goods only upon advance payment.

- Commissions on payments as established by art.63 Legislative Decree 206/2005 , no commissions are applied on any type of payment .

Article 6 - Delivery and transport of products

To make its deliveries to customers safe, fast and reliable, Punto Luce has chosen UPS, DHL and GLS.

Indicatively, without this entailing any constraints for Punto Luce and subject to the availability of the products on the market as well as any causes of force majeure, the goods will be delivered with the following timing: if all the goods are immediately available, the shipment will be entrusted to the courier within 24/48 hours of receipt of payment; the products will be delivered by the courier in the following 24/48 hours with the exception of the islands, for which 72 hours are expected.

The purchased products will be delivered by the courier to the address indicated by the Customer, therefore it is essential to indicate a delivery address complete in all its parts such as the house number and the exact name on the doorbell. Furthermore, UPS helps you not have your life affected by waiting for parcels. The customer will be able to send the products to one of the UPS Access Points™, which are neighborhood shops with which they collaborate, and then collect them at the most convenient time. In this way, the customer can be sure that the parcels will be safe and, thanks to places that remain open in the evenings and on weekends, it will be possible to collect them calmly.

Each shipment will be preceded by an email which will notify you of the shipment and will allow you to know the shipment number to follow its location.
Deliveries of the products by the courier will take place during all working days within 24/48 hours depending on the shipping area.

The transport contribution, to be added to the price of the products purchased, will be automatically calculated by the system based on the weight of the shipment and the delivery area. The shipment of the products by Web-E Srl may be split, upon request of the Customer upon payment of a new shipping cost contribution.

The products shipped are contained in cardboard boxes of different sizes, sealed at the top, bottom and sides with personalized tape.

We recommend (when purchasing fragile products) to select an insured courier.

Pursuant to art. 63 of the Consumer Code, any damage to the packaging/packaging of the products must be immediately contested by the Customer by placing a written control reservation on the proof of delivery. It is understood that, once the delivery document has been signed without any dispute, any exception regarding the external characteristics of what has been delivered will be precluded.

The Customer is required to verify, upon receipt, the conformity of the product delivered to him in relation to the order placed, as follows:

  • that the number of packages (number of packages) indicated on the carrier's letter corresponds to the number of packages actually delivered;
  • that the package is intact, not damaged or wet and in any case does not comply with the standard characteristics (described above) of a Punto Luce package.


Only after this verification will the Customer have to sign the delivery, after which he will not be able to make any objection regarding the external characteristics of what was delivered to him in relation to the order placed. However, if there is no correspondence between the order and delivery, according to the methods mentioned above, the Customer will not have to accept the goods and raise the dispute directly with the carrier.

In case of reports of broken goods we recommend signing with the words "RECEIVED WITH RESERVE FOR INTERNAL CONTROL".

In the event of problems, it is also good practice to keep all the packaging, parcel labels and anything else that may be useful to help quickly resolve the problem.

In the event that the courier has been chosen by the Customer outside of those proposed during the purchase phase, the risk of damage and destruction of the products is transferred to the Customer already at the moment of delivery to the carrier itself, precluding any dispute regarding the external characteristics of what was delivered. In this case, any dispute must be raised directly by the Customer against the courier.

Article 7 - Guarantee

All products marketed enjoy the legal guarantee of conformity provided for by articles 128 et seq. of the Consumer Code which covers any defects in conformity of the purchased items, existing at the time of delivery and which appear within 2 years of delivery itself. Any defects or damage caused by accidental events or by the Customer's responsibility for use of the products that do not conform to their intended use, or as a result of normal wear and tear, are excluded from defects of conformity and, therefore, from the legal guarantee. The Customer may ask, at his choice, the seller to repair the goods or replace it, without costs in both cases, unless the requested remedy is impossible or imposes disproportionate costs on the seller. The consumer customer has the right to a proportional reduction in the price or termination of the sales contract, in accordance with the provisions of the art. 135 bis, paragraph 4, Consumer Code and, in particular, if: the seller has not carried out the repair or replacement within the terms and conditions established by the Consumer Code, or has refused to make the goods compliant; if the lack of conformity is so serious as to justify the immediate reduction of the price or termination of the contract; if a lack of conformity occurs despite the seller's attempt to restore the conformity of the goods; if the seller has declared (or this is clear from the circumstances) that he will not proceed to restore the conformity of the goods within a reasonable period or without inconvenience. The consumer customer does not have the right to terminate the contract if the lack of conformity is only minor. To benefit from this guarantee, the customer must report the lack of conformity with a communication addressed to the seller indicating the defects and faults found. Unless proven otherwise, it is presumed that any lack of conformity which appears within one year from the moment the goods were delivered already existed on that date, unless this hypothesis is incompatible with the nature of the goods or with the nature of the defect. of compliance.

Pursuant to Legislative Decree 206/2005 ("Consumer Code"), all products on sale on puntoluce.net are covered by a 24-month legal guarantee.
Based on the 24-month Legal Guarantee, Punto Luce is responsible towards the consumer (the natural person acting for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out) for defects of conformity not detectable at the time of purchase .
The lack of conformity exists when the product is not suitable for the use for which it is usually intended, does not conform to the description or does not possess the qualities promised by the seller, does not offer the usual qualities and performances of a good of the same type, does not it is suitable for the particular use desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (art. 129 of the Consumer Code).
The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within the following 2 months from the date of discovery of the defect.
Unless proven otherwise, it is presumed that defects of conformity which appear within 6 months of delivery of the goods already existed on that date. In the event of a lack of conformity, the consumer has the right to have the conformity of the goods restored, without charge, by repair or replacement (art. 130 of the Consumer Code).
The consumer can ask the seller to repair the goods or replace them, free of charge in both cases, unless the requested remedy is objectively impossible or excessively onerous compared to the other. Repairs or replacements must be carried out within a reasonable period of time from the Consumer's request; the average time for returning the product to the Consumer is 24 days.
If Punto Luce is unable to return the repaired product within the maximum period of 60 days, the consumer may request one of the alternative remedies (replacement, termination of the contract, price reduction).
Punto Luce will send the product for any repairs to the Technical Assistance Center authorized by the Manufacturer.

Times and methods of exercising the Legal Guarantee for online purchases:
The Customer can report the defect of the purchased product by sending a written communication via the " Restoration of Conformity Defect " section.

Wait for the Return Authorization Number (NAR) identifying the case, which will be communicated by Punto Luce, and prepare the product for shipping by carefully packaging it and enclosing all accessories, the instruction manual and everything originally contained in the product packaging and indicating the Return Authorization Number on the packaging .

The transporter will contact the Customer to arrange collection of the product (the Customer's unavailability by telephone will delay the collection of the product).
Punto Luce will send the product for any repairs to the Technical Assistance Center authorized by the manufacturer itself.

What happens if the lack of conformity is not found?
If the lack of conformity is not found, Punto Luce will communicate the estimate to the Customer, who can decide whether or not to carry out the repair at his own expense. In this case, any transport costs and diagnosis of the defect requested by the technical assistance center remain the responsibility of the Customer.

Article 8 - Right of Withdrawal

Consumer right of withdrawal

Purchases made on puntoluce.net, like all remote purchases via telephone or correspondence, since they take place outside of commercial premises, are protected by Legislative Decree 6 September 2005, n. 206 and subsequent amendments (directive 2011/83/EU, implemented in Italy with Legislative Decree 21 FEBRUARY 2014, No. 21), which provides the possibility for the consumer to exercise the right of withdrawal.

Pursuant to art. 52 of the Consumer Code of Legislative Decree no. 206/2005 , if the Customer is a Consumer, he has the right to withdraw from the purchase contract for any reason, without any penalty and without prejudice to the provisions set out below. The Consumer can exercise the right of withdrawal within 14 days of receiving the goods. This right consists in the right to return the purchased good to the supplier without any penalty and without specifying the reason, and in the consequent reimbursement of the purchase price of the good.

The right applies to all products, with the strict exclusion of custom-made items (cables, etc.), created specifically , ordered specifically . Furthermore, goods for which the Consumer has paid less than 50 euros are excluded from the right of withdrawal.

Within 14 days, Punto Luce will reimburse the Consumer for all payments made to us for that product, including delivery costs (with the exception of additional costs resulting from the possible choice of a type of delivery other than the least expensive type), without undue delay and in any case no later than 14 days from the day on which we are informed of the decision to withdraw from this contract.

The refund will be made using the same payment method used for the initial transaction, unless the Consumer has expressly agreed otherwise. The refund may be suspended until the goods are received or until the consumer demonstrates that he has sent the goods back.

The consumer is only responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

Right of withdrawal of the Professional

According to the provisions of the Law, the right of withdrawal is reserved exclusively for Consumers (natural persons who purchase the goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal entities and natural persons acting for purposes relating to any professional activity carried out.

Article 12 - Jurisdiction and competent court

This contract will be governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Bologna.

Punto Luce in the name of Web-E Srl informs the user who qualifies as a consumer pursuant to art. 3, paragraph 1, letter. a) of the Consumer Code that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform can be consulted at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform the consumer user will be able to consult the list of ADR bodies, find the link to the website of each of them and start an online resolution procedure for the dispute in which he is involved.
