Consumer right of withdrawal
Purchases made on puntoluce.net, like all remote purchases via telephone or correspondence, since they take place outside of commercial premises, are protected by Legislative Decree 6 September 2005, n. 206 and subsequent amendments (directive 2011/83/EU, implemented in Italy with Legislative Decree 21 FEBRUARY 2014, No. 21), which provides the possibility for the consumer to exercise the right of withdrawal.
Pursuant to art. 52 of the Consumer Code of Legislative Decree no. 206/2005, if the Customer is a Consumer, he has the right to withdraw from the purchase contract for any reason, without any penalty and without prejudice to the provisions set out below. The Consumer can exercise the right of withdrawal within 14 days of receiving the goods. This right consists in the right to return the purchased good to the supplier without any penalty and without specifying the reason, and in the consequent reimbursement of the purchase price of the good.
The right applies to all products, with the strict exclusion of custom-made items (such as cables, etc.), created and ordered specifically.
According to Article 47, paragraph 2, of the Consumer Code, the provisions relating to the right of withdrawal do not apply to contracts where the consumer must pay a consideration not exceeding 50 euros (so-called low-value contracts).
Methods for exercising the Consumer's right of withdrawal
A return can be requested independently by a customer from the order section of his personal area. For only the products for which the return can be requested, the date by which you can request it will be shown and the button to start the return of the products will be present.
The following are the steps the customer takes to make the return request:
- Go to the orders page after logging in
- Click on Return products corresponding to the shipment in which the products you want to return are present
- If necessary, change the quantity you want to return
- Select the reason from those available
- Leave if you want comments
- Add other products to the return if necessary
- Click the button to request a return
Return address
Products for which a return has been requested and approved must be sent within 14 days to the address provided in the authorization.
Please note that return shipping costs are the responsibility of the customer.
Refund
Within 14 days, Punto Luce will reimburse the Consumer for all payments made for that product, including delivery costs (with the exception of additional costs resulting from the possible choice of a type of delivery other than the least expensive type), without undue delay and in any case no later than 14 days from the day on which we are informed of the decision to withdraw from this contract.
The refund will be made using the same payment method used for the initial transaction, unless the Consumer has expressly agreed otherwise. The refund may be suspended until the goods are received or until the consumer demonstrates that he has sent the goods back.
The consumer is only responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
Right of withdrawal of the Professional
According to the provisions of the Law, the right of withdrawal is reserved exclusively for Consumers (natural persons who purchase goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal entities and natural persons acting for purposes relating to any professional activity carried out.
